Rhyl man attacked his dad after being told to leave his home

Justin Turton, 35, of East Parade, was living in a caravan in his parents’ garden in Kinmel Bay when this incident took place last summer.

He denied actual bodily harm, but was convicted after a trial and sentenced to a community order involving unpaid work.

He appeared at Caernarfon Crown Court on Friday (March 20) to appeal his conviction, but withdrew his appeal midway through the hearing.

Prosecutor Amy Edwards said Turton’s parents put a caravan in their garden to allow him to live there after he had lost his job and been evicted from his flat in Rhyl.

But after an argument broke out on June 4, 2025, his father, Andrew Turton, told him to leave the property, before removing an electric cable from the caravan and striking his son with it.

Andrew Turton, 53, of Bodelwyddan Avenue, Kinmel Bay, admitted assault by beating at Llandudno Magistrates Court in November, and was fined £500 and handed a restraining order.

But Justin Turton, while “smirking and laughing,” refused his father’s repeated requests, before telling him: “If you f***ing touch me again, I’m going to f***ing smash the s*** out of you.”

He then punched his father to the face several times, causing him to sustain a black eye.

The defendant filmed this incident on his mobile phone; this footage was played in court during Friday’s hearing.

Justin Turton could be heard on the video telling his father: “Mate, you’re going to jail tonight,” while his mother, Cindy Turton, told him: “Don’t you dare hit your dad like that.”

He claimed his father had “just attacked” him, and was acting in self-defence.

Giving evidence at Friday’s hearing, Mrs Turton said she and her son had been to Prestatyn to collect a television for him that day, when an argument began during the car journey home.

Tensions were “very” high that day, she said, with Justin Turton telling her he “wasn’t going anywhere” and threatening to “batter” his father.

Minutes after they returned home, Andrew Turton also arrived back at their house, having been at work – the fight broke out shortly afterwards.

“I’ve never seen my husband angry or aggressive like that, in the 35 years we’ve been married,” Mrs Turton said.

“They were shouting at each other, and the next minute, they just went for each other. It was just horrible, and I was in complete shock.

“Justin can get angry, but I’ve never seen him be really aggressive, or fight.”

Mrs Turton added that her son was “goading” his father, despite her asking him to “please just stop it”.

She said Justin Turton began “dancing around, like he was a boxer,” before “punching hell out of his dad”.

“I just felt Justin was provoking and inflaming the whole situation,” Mrs Turton added.

“It was absolutely horrendous and horrible.

“I love my son so much. I miss him. I hadn’t seen him for eight months, and the first time I saw him (since then) was in the dock. But he shouldn’t have done that to his dad.”

A lunch break followed Mrs Turton’s evidence, during which time Justin Turton was remanded in custody.

Following the break, his barrister, Catherine Elvin, confirmed he wished to withdraw his appeal against his conviction.

Judge Nicola Jones, presiding over the appeal hearing with magistrates, said she had detected “no remorse” from Justin Turton.

She added: “Quite frankly, in my mind, this could have been a crown court case, and it would have been subjected to a custodial sentence, which might have been suspended.

“But given his attitude, maybe not.”

Judge Jones said the video footage of the incident was “really compelling,” and described Mrs Turton’s evidence as “heart-breaking”.
