A takeaway and restaurant in Rhyl has been granted a licence to sell alcohol until 1am despite local objections.

The application was made by Md Muhim Uddin for his new restaurant in the town which opened earlier this month.

The Rhyl Spice restaurant and take away 64-66 Queen Street, Rhyl will now be able to serve alcohol with meals until the early hours of the morning.

Originally the application had been to allow service until 2am but Peter Williams, Mr Uddin’s legal representative explained that what was required was the right to sell alcohol until 1am with a one hour period for restaurant customers to consume their drinks.

Two objections had been received by Denbighshire County Council’s licensing sub committee, which considered the application.

These related to fears over odour from the kitchens and noise pollution from late night diners.

Mr Williams dismissed these objections saying that as the restaurant had only been open for two weeks they could only relate to previous operations at the site.

He said: “Staff will always organise taxis to take customers away from the premises and encourage persons on foot to disperse and ensure that noise and vibration does not emerge from the site towards the residential area close to the property.

“I can advise that Mr Uddin has carried out refurbishment of the extraction system by extending the ventilation shaft so that it comes out at a higher level which should dissipate any smells that pull through the filters.”

Council officers had offered to facilitate mediation between the applicant and the objectors but this did not take place.

Mr Williams added: “The public notice went out on March 2 and the closing date was March 28 both representations were submitted late on the afternoon of March 21.

“The objectors up to last Thursday had failed to mediate despite numerous attempts to make contact.”

The three member panel, a sub committee of the licensing committee, agreed to grant the licence.
